The same thing just happened to me recently - biker turned into my lane without looking and smashed into the side of my car. Damage was pretty bad but my insurance was kind enough to cover it all.

The mofo can claim that id3379 was to far out into his path of traffic. I suggest gathering evidence that Mr. mofo was not in his lane.

Big Corporations don't care about right/wrong, all they care about sadly is money.

My insurance is considering it my fault, i gave them proof of why its not, They still think he was the victim. And unless i wanna take them to court and get into expensive laywer fee's there's nothing i can really do against them.

Sucks but it could be worse. I just make sure im way farther back from now on.

1) How does an officer not write a police report at the seen of an accident...I can see if the damage was less than $500 and you have a $500 deductable. But that looks like a whole new bumper which is more than $500 for sure.

2)Did the guy get ticketed? I don't see how he didn't as he was clearly in your lane? Did the officer assign fault?

3)How the hell does an insurance company that you make payments to every month/6 months deny a claim from an accident? Is it because there was no ticket written?

4)How is the guys back hurting your problem? He ran into you...although if there wasn't any fault assigned or a ticket written I don't really think you have a leg to stand on with the insurance company

For $800 I'm pretty sure you can take them to small claims court...which the threat of will likely threaten them enoug that they'll just pay you. Although them paying you and NOT his insurance company, who should be the ones paying, will result in your rates being raised
